The App is distributed solely on the United States App Store, and we do not target or market the Services to individuals in the European Union, United Kingdom, or elsewhere. 1. What Information Do We Collect?

Personal information you disclose to us. In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

Sensitive Information. We do not intentionally collect sensitive information, and we ask that you not speak it into the voice feature. If a spoken question happens to contain sensitive information, we process it only to generate your answer and for no other purpose.

Payment Data. We do not collect or store your payment card number, security code, or other payment instrument details. All purchases are processed by Apple, which handles and stores your payment information; we receive only a transaction identifier and your subscription status from Apple. Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Apple or Google account. If you choose to register in this way, we will collect certain profile information about you from the provider, as described in the section called "How Do We Handle Your Social Logins?" below.

Information Automatically Collected. In Short: Some information — such as your IP address and device characteristics — is collected automatically when you use the Services.

When you use the App, we automatically collect certain information needed to operate, secure, and troubleshoot the Services and for internal analytics. This may include your IP address, device and operating-system information, app version, and usage and diagnostic data (such as which features you use and error logs).

Voice Input. When you use the voice feature, the audio of your spoken question is streamed to our server and to our speech-to-text provider to convert it to text. Your podcast audio and its transcription stay on your device and are not uploaded. See "Do We Offer Artificial Intelligence-Based Products?" below for how your question is processed.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Google API. We use Google only as an optional sign-in provider; the App is distributed solely through the Apple App Store and all purchases are processed by Apple. Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Our Services offer you the ability to register and log in using your third-party account details (like your Apple or Google logins). Where you choose to do this, we will receive certain profile information about you from your provider. The profile information we receive may vary depending on the provider concerned, but will often include your name and email address, as well as other information you choose to make available.

We will use the information we receive only for the purposes that are described in this Privacy Policy or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information.

6. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). In general, we keep account information for as long as you have an account with us. When you delete your account, we delete your account information from our active systems promptly, and any copies remaining in routine backups are overwritten on our normal backup rotation (typically within 30 days). Server and diagnostic logs are retained for a limited period (typically up to 90 days) for security and troubleshooting. Billing records are retained as long as required for tax and accounting purposes. We do not retain the audio of your spoken questions after the reply is generated. We do not maintain a server-side record of your questions or the co-host's replies: your recent conversation history is stored on your device and sent to us only to provide context for your next question. The transcribed text of a question may appear briefly in the server and diagnostic logs described above, which are subject to the same limited retention period.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if that is not possible (for example, because it is held in a backup archive), we will securely store it and isolate it from any further processing until deletion is possible.

7. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. Do We Collect Information From Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. The Services are intended only for users who are at least 18 years old, and by using the Services you represent that you are at least 18. If we learn that personal information from a user under 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 9. What Are Your Privacy Rights?

In Short: You may review, change, or terminate your account at any time, depending on your state of residence in the United States.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in the section "How Can You Contact Us About This Policy?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Service communications: We do not send marketing or promotional email. We may still send you service-related messages that are necessary for the administration and use of your account, to respond to support requests, or for other non-marketing purposes.

Account Information. If you would at any time like to terminate your account, you can delete it from the app's Settings. The profile details associated with your account (such as your name and email) come from your Apple or Google sign-in; to change those, update them with that provider. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms, and/or comply with applicable legal requirements.

10. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

11. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of a U.S. state with a comprehensive consumer privacy law (including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia), you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.

Categories of Personal Information We Collect. The list below shows the categories of personal information we have collected in the past twelve (12) months, and whether we collected each:

We will use and retain the collected personal information as needed to provide the Services or, for Categories A, D, and F, as long as the user has an account with us (subject to the retention periods described in "How Long Do We Keep Your Information?" above). The Category H audio is an exception: it is processed only transiently to generate your reply and is not retained afterward, as described in "How Long Do We Keep Your Information?" above.

Sale or Sharing of Personal Information. We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising, as those terms are defined under California and other US state privacy laws. We have not sold or shared personal information for such purposes in the preceding twelve (12) months. We also do not knowingly sell or share the personal information of consumers under 18 years of age, and we do not use sensitive personal information for purposes other than those permitted under applicable law.

Your Rights. You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

Depending upon the state where you live, you may also have additional rights, such as the right to access the categories of personal data being processed, to obtain a list of categories or specific third parties to which we have disclosed or sold personal data, to review and question how personal data has been profiled, to limit the use and disclosure of sensitive personal data, and to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature, in each case as permitted by the applicable state privacy law.

How to Exercise Your Rights. To exercise these rights, you can contact us by emailing us at james@tryquenelle.com, or by referring to the contact details at the bottom of this document. Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification. Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request.

Appeals. Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at james@tryquenelle.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law. California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
